Praktika, Werkstudentenverträge und Minijobs sind vom Empfehlungsprogramm ausgeschlossen. Zugang zum Empfehlungsprogramm steht natürlichen Personen offen, die ihren Wohnsitz in Deutschland haben und das 18. Lebensjahr erreicht haben. Die Teilnahme ist nur während des festgelegten Teilnahmezeitraums möglich. Empfehlungen, die nach Ablauf dieser Frist eingehen, werden nicht berücksichtigt. Eine wirksame Teilnahme am Empfehlungsprogramm setzt voraus, dass sämtliche erforderlichen personenbezogenen Daten vollständig und wahrheitsgemäß angegeben sind. Die empfohlene Person darf nicht bereits Kunde von Manual Job Search gewesen sein.

Teilnahme am Empfehlungsprogramm

Die Teilnahme am Empfehlungsprogramm ist nicht auf Kunden von Manual Job Search beschränkt und erfordert keinen Kauf von Waren oder Dienstleistungen. Sollte ein Teilnehmer in seiner Geschäftsfähigkeit eingeschränkt sein, bedarf es der Zustimmung seines gesetzlichen Vertreters. Der Betreiber kann nach eigenem Ermessen Teilnehmer von der Teilnahme ausschließen, wenn berechtigte Gründe vorliegen, wie beispielsweise: a. Manipulationen in Bezug auf den Zugang zum Empfehlungsprogramm oder dessen Durchführung, b. Verstöße gegen diese Teilnahmebedingungen, c. unlauteres Verhalten oder d. falsche oder irreführende Angaben im Zusammenhang mit der Teilnahme am Empfehlungsprogramm. In solchen Fällen behält sich Manual Job Search das Recht vor, Prämien nachträglich zu entziehen oder zurückzufordern und gegebenenfalls Schadensersatzansprüche geltend zu machen. Manual Job Search haftet nicht für Schäden, die durch Fehler, Unterbrechungen und/oder Verzögerungen bei der Übermittlung, Störungen der technischen Einrichtungen und des Services, unrichtige Inhalte, Löschung und Verlust von Daten, Viren oder auf andere Weise bei der Teilnahme am Empfehlungsprogramm entstehen können, es sei denn, solche Schäden werden von Manual Job Search vorsätzlich oder grob fahrlässig verursacht.

Die Bewerbungsunterlagen der empfohlenen Person werden zunächst daraufhin überprüft, ob Manual Job Search diese Person als Kunden für die Vermittlung akzeptiert. Manual Job Search ist nicht verpflichtet, jede empfohlene Person als Kunden zu akzeptieren, weshalb eine Ablehnung möglich ist. Bei erfolgreicher Vermittlung benachrichtigt die empfohlene (vermittelte) Person den Empfehlenden zeitnah über den Vertragsabschluss. Die empfohlene Person nennt Manual Job Search die empfehlende Person. Der Empfehlende teilt Manual Job Search seine Bankverbindung mit. Die ausgelobte Prämie wird an den Empfehlenden überwiesen, nachdem Manual Job Search die Provision für die Vermittlung vollständig oder die erste Rate bzw. die erste Rate des Vermittlungsgutscheins erhalten hat. Die Prämie wird dem Empfehlenden überwiesen. Falls aus Gründen, die nicht in der Verantwortung von Manual Job Search liegen, die Überweisung nicht innerhalb von zwei Monaten nach Benachrichtigung erfolgen kann, verfällt die Prämie. Es bestehen dann keine Ansprüche gegen Manual Job Search. Umtausch, Selbstabholung und Barauszahlung der Prämie sind nicht möglich. Der Empfehlende ist selbst für die eventuell anfallende Versteuerung der Prämie verantwortlich.

Dauer des Empfehlungsprogramms

Manual Job Search behält sich ausdrücklich das Recht vor, das Empfehlungsprogramm ohne vorherige Ankündigung und ohne Angabe von Gründen zu beenden. Sollte die Durchführung aus rechtlichen oder technischen Gründen nicht möglich sein, haben die Teilnehmer keinen Anspruch auf Durchführung gegenüber Manual Job Search.

Zur Durchführung des Empfehlungsprogramms werden die persönlichen Daten der teilnehmenden Personen, wie Name, E-Mail-Adresse, Anschrift und Alter, benötigt. Diese Daten werden ausschließlich zur Abwicklung des Empfehlungsprogramms verwendet und nach dessen Durchführung sowie Ablauf der gesetzlichen Aufbewahrungsfristen gelöscht. Die Daten der am Empfehlungsprogramm teilnehmenden Personen werden nicht verkauft, können jedoch von Manual Job Search für Werbezwecke, Informationen und Marktforschungszwecke genutzt werden. Die Einwilligung zur Speicherung und Auswertung der Daten kann durch die Teilnehmer jederzeit widerrufen werden. Die Teilnehmer erkennen an, dass Manual Job Search unter Umständen gesetzlich dazu verpflichtet ist, den Namen des Empfängers einer Prämie bekannt zu geben. Die Teilnehmer sind sich bewusst, dass eine gesetzliche Verpflichtung zur begrenzten Aufzeichnung und Speicherung der Daten besteht.

Für die Durchführung dieses Empfehlungsprogramms gilt ausschließlich das Recht Singapurs. Gerichtsstand ist Singapur. Sollten einzelne Bestimmungen des Empfehlungsprogramms ungültig sein oder werden, bleiben die übrigen Punkte des Programms unberührt. Die Teilnahmebedingungen können jederzeit ohne gesonderte Benachrichtigung geändert werden.

The general terms and conditions

Our general terms and conditions for participation in our referral programme apply in their current version at the time of use. Any separate terms and conditions of participation will be announced independently of this, and each participant accepts these terms and conditions for participation in the referral programme by participating. Participation in the referral programme is free of charge.

Eligibility to participate

Internships, student work contracts, and mini-jobs are excluded from the referral programme.
Access to the referral programme is open to individuals who are resident in Germany and have reached the age of 18.
Participation is only possible during the specified participation period. Recommendations received after this period will not be considered.
Effective participation in the referral programme requires that all necessary personal data be provided fully and truthfully.
The recommended person must not have already been a customer of Manual Job Search.

Participation in the referral programme

Participation in the referral programme is not restricted to customers of Manual Job Search and does not require the purchase of any goods or services.
If a participant has limited legal capacity, the consent of their legal guardian is required.
The operator may, at their discretion, exclude participants from taking part if there are legitimate reasons, such as:
a. Manipulations regarding access to or implementation of the referral programme,
b. Breaches of these terms and conditions,
c. improper conduct or
d. false or misleading information in connection with participation in the referral programme. In such cases, Manual Job Search reserves the right to subsequently withdraw or reclaim rewards and, if applicable, to assert claims for damages.
Manual Job Search shall not be liable for damages arising from errors, interruptions, and/or delays in transmission, failures of technical equipment and services, incorrect content, loss or deletion of data, viruses or otherwise, in connection with participation in the referral programme, unless such damages are caused intentionally or by gross negligence by Manual Job Search.

Receipt of the premium

The recommended person's application documents will first be checked to see if Manual Job Search accepts this person as a client for placement. Manual Job Search is not obliged to accept every recommended person as a client, which is why rejection is possible.
Upon successful placement, the recommended (referred) person shall promptly notify the referrer of the contract conclusion. The recommended person shall name the referring person to Manual Job Search. The referrer shall provide Manual Job Search with their bank details. The advertised bonus will be transferred to the referrer after Manual Job Search has received the full commission for the placement or the first instalment of the placement voucher.
The premium will be transferred to the referrer. If the transfer cannot be made within two months of notification for reasons beyond
Exchange, self-collection and cash payment of the bonus are not possible. The recommender is responsible for paying any taxes on the bonus.

Duration of the referral programme

Manual Job Search expressly reserves the right to terminate the referral programme without prior notice and without stating reasons.
If the performance cannot be carried out for legal or technical reasons, the participants shall have no claim to performance against Manual Job Search.

Data protection

To run the referral programme, the personal data of participating individuals, such as name, email address, address, and age, will be required. This data will be used solely for the purpose of managing the referral programme and will be deleted after its completion and the expiry of statutory retention periods.
The personal data of individuals taking part in the recommendation programme will not be sold, but Manual Job Search may use it for promotional, informational, and market research purposes.
Consent to the storage and analysis of the data can be revoked by participants at any time. Participants acknowledge that Manual Job Search may be legally obliged to disclose the name of a prize recipient.
The participants are aware that there is a legal obligation to limitedly record and store the data.

General information

The law of Singapore shall apply exclusively to the execution of this referral programme.
The place of jurisdiction is Singapore.
Should individual provisions of the referral programme be or become void, the remaining points of the programme shall remain unaffected.
The conditions of participation can be changed at any time without separate notification.
